These Terms and Conditions govern your use of SmartiChat, a live chat and AI assistant platform operated by Soft3Tech LLC. By using SmartiChat, you agree to be bound by these terms.
2. Contract Formation
By registering for SmartiChat, you are making a binding offer to use the service. A contract is formed once we confirm your registration.
3. Services Provided
SmartiChat provides AI-powered live chat services. The features available to you depend on your selected subscription plan. We reserve the right to make improvements, changes, or limitations to certain features without prior notice.
4. Trial Period
We offer a free 7-day trial with the following conditions:
- No payment information is required during the trial.
- After 7 days, the trial account will be deactivated unless a paid subscription is activated.
5. Subscription Terms
After the trial, you may subscribe monthly or annually. Subscriptions begin upon successful payment. By subscribing, you acknowledge that you waive any cancellation rights, having already used the product during the trial period. Refunds are not available after payment.
6. Cancellation and Account Deletion
- You may cancel your subscription at any time. Access continues until the end of the current billing period.
- You may request early account deactivation, ending access immediately.
- All data will be permanently deleted 30 days after access ends, unless otherwise required by law.
- You may reactivate your account within the 30-day window. The deletion period resets with each deactivation.
7. Payment Terms
Prices are listed in U.S. dollars. Payments are processed via secure third-party providers. In case of failed or delayed payments, we reserve the right to suspend your access until the issue is resolved.
8. Acceptable Use
You agree not to:
- Submit illegal or harmful content via the platform
- Attempt to disrupt, damage, or gain unauthorized access to the service
- Infringe on any intellectual property or privacy rights of others
9. Limitation of Liability
Soft3Tech LLC is not liable for any indirect, incidental, or consequential damages. Our liability is limited to damages caused by gross negligence or intentional misconduct.
10. Data Use
We process your personal data in accordance with our Privacy Policy. By using SmartiChat, you consent to the use of your data as necessary to provide the service.
11. Changes to These Terms
We may update these terms at any time. We will notify you of material changes. Continued use after notification indicates your acceptance of the updated terms.
12. Governing Law
These Terms and Conditions are governed by the laws of the State of Missouri, USA. Any disputes will be handled in the appropriate state or federal courts located in Missouri.
